According to Art. 13 of the Leg. Decree number 196/2003, the Parties agree that their personal data in virtue of the present Contract will be treated according to the principles of correctness, lawfulness, transparency and protection of the privacy and of the counterpart rights.

In particular:

 

a)      the data acquired by the Parties in virtue of this Contract, included the data that will be acquired during the execution of the Contract, that will be treated with the aid of electronic and/or automatic devices for purposes regarding the management and the execution of the obligations of the Contract, for checks and variations on the results and the progress of the relation, for obligatory fulfilment according to the law (e.g. for taxes, or accounting purposes, etc.);

b)      the assignment of optional data, even though any refusal to provide them would impede the conclusion of the Contract or could determine difficulties in the execution of the Contract;

c)      the data will be communicated, as per the illustrated purposes, solely to subjects entitled from the Parties to treat the data, for which they are liable, and to subjects that, according to the law, should be informed of them, and for the fulfilment of the obligations of the present Contract;

d)     the Parties can, in any moment, obtain the cancellation, the update, the adjustment, the integration of their personal data, and have the rights listed in the following Art. 7 of the Leg. Decree 196/2003:

Art. 7 Leg. Decree number 196/2003 - Right of access to personal data and other rights

1. The interested person has the right to obtain the confirmation of the existence or absence of their personal data, even thought not yet registered, and have the right to receive intelligible communication.

2. The interested person has the right to obtain the indication:

a) of the origin of the personal data;

b) of the purposes and modalities of the treatment;

c) of the logic applied in case of treatment performed with the aid of electronic devices;

d) of the identification data of the owner, of the responsible people and of the appointed representative according to art. 5, par. 2;

e) of the subjects or the categories of the subjects to whom the personal data could be communicated as appointed representative in the territory of the Country.

3. The interested person has the right to obtain:

a) the update, the adjustment and, if the case, the integration of the data;

b) the cancellation, the change in anonymous form or the block of the data treated not according to the law, included those for which it is not necessary the conservation according to the purposes for which the data have been collected or treated;

c) the attestation that the operations as per letters a) and b) have been communicated, also in their contents, to those to whom the data should be communicated, with the exception of the case in which such communication is impossible or involves means that are disproportionate to the protected right.

4. The interested person has the right to oppose, totally or in part:

a) for legitimate reasons, to the treatment of their personal data, even thought pertinent to the purpose of the collection;

b) to the treatment of their personal data for the dispatch of advertisement material or direct sale or for market surveys or commercial communications.

The Parties agree that they have received the above mentioned information and, according to Art. 23 of the Leg. Decree 196/2003, clearly accept the Special Conditions of the present Contract and the treatment, the communication and the transfer abroad of their personal data, including the adjustments, according to the terms and modalities of the above mentioned information.
